States are required to report data to monitor the overrepresentation of youth of color in juvenile justice. In addition to reporting data, states are required to submit an assessment of DMC to the Office of Juvenile Justice and Delinquency Prevention. This four page brief provides an overview which states also make these assessments publicly available and provides an overview of the challenges states faces in conducting the research and the range of reform recommendations they make.

This Checklist was developed with assistance from the MacArthur Foundation Juvenile Indigent Defense Action Network to help to explain many of the consequences of being arrested as a juvenile in Pennsylvania. The Checklist is a resource for attorneys, child advocates, judges, and communities about the impact of contact with the juvenile justice system. With the help of partner organizations, the Checklist was translated into Spanish.

Racial and Ethnic Fairness in Juvenile Justice: Availability of State Data

NCJJ has released a new StateScan publication that summarizes the results from a review of publicly available data that describe racial and ethnic fairness across the country. This StateScan publication is the 7th in a series that distills important knowledge from NCJJ’s new Juvenile Justice Geography, Policy, Practice & Statistics website (www.JJGPS.org).

The author organizes results from a national search for publicly available state-level sources for racial and ethnic fairness data. This publication outlines important details provided in the data, describes the importance of sharing this data publicly, and discusses the underlying obstacles to data collection. This original analysis also describes the federal requirements to collect and report this data; however, few states share this information with the public.

Race Matters: Reducing Racial and Ethnic Disparities in the Juvenile Justice System

Racial and ethnic disparities are one of the most pervasive and disturbing characteristics of our juvenile justice system. Youth of color are over-represented at key decision points, including arrest, referral, detention, transfer to adult criminal court, and commitment to state custody. As the National Research Council noted in a comprehensive review of the literature, “Several recent careful reviews…have found that ‘race matters’ beyond the characteristics of an offense.”

At the same time, many juvenile justice officials find it difficult to discuss racial bias. Avoidance, denial, and fear of being the object of accusations impede attempts at reform. Moreover, despite decades of efforts to study and address disparities, few jurisdictions have implemented reforms with measurable impacts on youth of color.

For all of these reasons, juvenile justice stakeholders, and particularly judges, should be aware of the scope of the problem, how it affects court proceedings, and effective remedial strategies.

The over-representation of youth of color in the juvenile justice system has drawn national and local attention since the 1980’s and hundreds of thousands, if not millions of federal, state and private dollars have been dedicated to addressing the issue. Despite this attention, the over-representation of minority youth at every stage of the juvenile justice process persists with very little change. Although the juvenile crime rate is at one of its lowest points in history and progress has been made in reducing overall juvenile detention rates, youth of color continue to be disproportionately arrested, referred to juvenile court, prosecuted, detained and sentenced to secure confinement compared to their white peers.
There is clear evidence of persistent over-representation of youth of color at each stage of the juvenile justice system. The Washington State Center for Court Research (“WSCCR”) analyzed statewide court data from 2009 and found strong evidence of overrepresentation at the early stages of contact with the juvenile justice system:

In Their Own Words: Young People’s Experiences in the Criminal Justice System and Their Perceptions of Its Legitimacy

While there is a growing consensus that the country needs to re-examine the criminal justice system’s prosecution of serious young offenders, there is little documentation of how this population actually experiences and perceives the laws, policies, and practices that are intended to hold them accountable.

From a policymaking perspective, this lack of information weakens our ability to assess and improve the justice system’s response to serious crime committed by young people. How can we determine the impact of
criminal penalties on young people if we don’t understand what they know about the law? How do we know if the judicial system is doing a fair and effective job of holding serious young offenders accountable if we don’t question how this population experiences the judicial process? How can we understand the impact our correctional system has on this population if we don’t ask young prisoners to reflect on their experience of incarceration?

In this report, the John Howard Association (JHA), Illinois’ only independent prison watchdog and justice reform advocate, seeks to answer some of these questions as well as provide more general insight into how serious young offenders perceive the criminal justice system’s legitimacy.

Innovation Brief: Bringing Restorative Justice into the Classroom: Partnering with Schools to Reduce Juvenile Justice Referrals

In Peoria, Illinois, a large number of African American youth were entering detention for aggravated battery in one public high school. After learning more about the problem, juvenile justice and school officials launched a pilot project to address fights and other incidents on campus using principles of balanced and restorative justice (BARJ). Once implemented, the low-cost interventions resulted in a 35 percent reduction in schoolbased referrals to detention for all youth, and a 43 percent reduction for African American youth. This pilot project served as a springboard for broader implementation of
BARJ programming as an alternative to formal processing– both in school and out in the community.

This DMC assessment process sought to combine available data with the experiences, beliefs, and knowledge of local stakeholders in order to uncover those areas in which DMC is considered to be an issue of importance, to discover what communities may be doing to address DMC, and to provide suggestions on positive directions communities can take to address DMC. For those communities or interviewees with less experience in thinking about and acting on DMC, this process was also intended to provide a starting point for beginning that conversation.
